1. Who you are contracting with

These terms govern your use of the High Performance Yoga AI sequence builder (the "Service"), provided by High Performance Yoga, LLC("we", "us"). By creating an account or using the Service, you agree to these terms. You must have authority to bind your organization if subscribing on its behalf, or be of legal age if subscribing as an individual.

2. The Service

The Service generates structured yoga class plans using AI, lets you save and edit them, and produces printable teacher sheets. We do not guarantee uninterrupted or error-free operation.

3. Account use

You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep it current.

4. Acceptable use

You must not:

• use the Service unlawfully or to defraud, spam, or harass others;
• infringe anyone's intellectual property or privacy;
• probe, scan, scrape, or interfere with the Service's security or infrastructure;
• upload malware, or attempt to reverse engineer, resell, or sublicense the Service;
• use the AI to generate illegal content, deepfakes of real people, hate speech, or content designed to deceive or harm.

5. AI-generated content

You are responsible for the prompts you submit, the rights to any input you provide, and how you use the outputs. AI outputs may be inaccurate or anatomically imperfect — they are a starting point for a qualified teacher, not medical, physiotherapy, or professional advice. Verify all cueing and modifications before teaching.

We may filter, refuse, or remove outputs and suspend accounts that violate these terms or generate prohibited content. We respect rights-holder complaints — contact us to request takedown of content that infringes your rights; repeat infringers will be terminated.

6. Intellectual property

We retain ownership of the Service, our software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your active plan. You retain rights to the prompts and sequences you create; you grant us a limited license to host and process them solely to provide the Service.

7. Payment and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, suspected fraud or security risk, or repeated policy violations. On termination you may export your sequences for 30 days, after which we may delete your data.

9. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the prior 12 months. We are not liable for indirect, consequential, or special damages (lost profits, data, or goodwill), except where liability cannot be excluded by law.

10. Indemnity

You will indemnify us against third-party claims arising from your content, your use of outputs, or your breach of these terms.

11. Governing law

These terms are governed by the laws of the State of California, USA. Disputes are subject to the exclusive jurisdiction of the courts of California, except where mandatory consumer law provides otherwise.

12. Changes

We may update these terms; we will notify active subscribers by email. Continued use after changes constitutes acceptance.
